John rented a two bedroom home in the nicer part of town near campus with his college roommate Will Sells. The movers were in the process of moving John’s furniture into the home when he quietly stated under his breath to himself “man I cannot stand some of this furniture, when I get back from the Thanksgiving break I am going to sell most of it and get new stuff.” Will heard John’s comment so wanting to help his friend he decided to have a garage sale during the break since he was not going back home for the holidays. Will sold all of John’s furniture and placed $1,500.00 in his room with a note saying “Dude you can now go get all your new stuff. Your Bro, Will.” When John returned back from the break and saw the note in his bedroom he immediately started to yell and cry all at the same time at the thought that Will had sold his favorite chair that his grandfather had handed down to him.
Can John legally recover his personal property from the people that purchased it? If they say no, what can John legally do?
Can John legally prevail against Will to recover his furniture? Can John recover for his emotional damages?
