LEGAL SITUATION: LEARNER’S PERMIT


Client, a legal resident, walks in and states that they were involved in a car accident.


Client is currently in the process of completing their citizenship application. Client was not found at fault for causing the accident but they did receive a Uniform Traffic Citation (UTC) for violating Florida Statute §322.1615 (Learner’s Driver License) because at the time of the accident they were driving the car without being accompanied with a person that was at least 21 years of age.


What should the client do about the following: 1) Immigration: Will this violation affect the client’s citizenship efforts?; 2) Personal Injury: Does the traffic violation change the liability position?; 3) Traffic Violation: How should the client handle the traffic violation—pay it, attend a driver improvement course, go to court? How does this affect their driving record?
